Reaffirming Texas’ sovereignty under the Texas Constitution and the Tenth Amendment to the U.S. Constitution.

This Non-Binding Resolution was introduced on March 7th, 2013 by Representative James White who represents Hardin, Jasper, Newton, Polk, and Tyler counties. Once you’ve read the text, feel free to comment below!

CONCURRENT RESOLUTION

WHEREAS, The Republic of Texas existed as an independent nation for nine years, and when it accepted admission to the Union in 1845, it remained a free and independent state subject only to the United States Constitution; and

WHEREAS, The United States Congress has passed laws requiring Texas to make expenditures that are unfunded by the federal government, which is a violation of the Tenth Amendment to the U.S. Constitution; moreover, the federal government has caused the intentional devaluation of its currency through its reckless spending and borrowing, and this threatens the economic stability of Texas; and

WHEREAS, The United States government has allowed the use of its authority, credit, and goodwill for the benefit of private and foreign concerns in violation of its own constitution; in addition, its repeated failure to guard the border between Texas and Mexico has forced the state to spend vast sums in order to protect its citizens; and

WHEREAS, The federal government has further implemented thousands of laws, mandates, and agencies in violation of the United States Constitution and of the sovereignty of the State of Texas; and

WHEREAS, Section 1, Article I, Texas Constitution, states that “the perpetuity of the Union depend[s] upon the preservation of the right of local self-government, unimpaired to all the States”; Section 2, Article I, declares, “All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient”; now, therefore, be it

RESOLVED, That the 83rd Legislature of the State of Texas hereby reaffirm the state’s sovereignty under the Texas Constitution and the Tenth Amendment to the Constitution of the United States; and, be it further

RESOLVED, That the Texas secretary of state forward official copies of this resolution to the president of the United States, to the president of the Senate and the speaker of the House of Representatives of the United States Congress, and to all the members of the Texas delegation to Congress with the request that this resolution be officially entered in the Congressional Record as a memorial to the Congress of the United States of America.

  1. While the resolution sounds good it states it is non binding. Is there any real truth to the belief that Texas can secede if it so chooses? I have yet to see actual verbiage in any document.

    • DAVE …I have read the CONTRACT (AND IT IS A CONTRACT) that the NATION of Texas joins the United States. It immediately, in NO UNCERTAIN TERMS, retains TEXAS SOVEREINTY TO LEAVE THE UNION AT TEXAN DISCRETION …IF CONSTITUTITONAL RIGHTS ARE MESSED WITH. Technically, because TEXAS IS /WAS A NATION… it is very different from other states in that the UNITED STATES OF OBAMA AND NEAPOLITANO HAVECHOSEN ….TO VIOLATE THIS CONTRACT. SINCE SOME PEOPLE TALK ABOUT …CRAP LIKE PAYING DEBTS AND STUFF…. THIS IS NOT TRUE. IN THIS CASE …THE LAW TO BE USED TO DETERMINE ANY UNSPECIFIED MONEY ISSUES IS NOT IN THE CONTRACT. THEREFORE, AFTER TEXAS TAKES FULL CONTROL OF ITS BORDERS, THE LAWYER TYPES WILL HAVE TO AGRREE FIRST ON IF ENGLISH COMMON LAW WILL BE USED IN THIS ISSUE. SECOND, SINCE OBAM AND NEAPOLITANO AREE THE CONTRACT BREAKERS … IN MOST CONTRACT NEGOTIATIONS …THEY WILL OWE TEXAS ANY DAMAGES FOR BREAKING SAID CONTRACT. IMHO

    • Davie is on the money – “it’s a resolution!” It does nothing but goes into file 13 (trash can) in D.C.. The Texas Nationalist Movement is a “NO GO movement.” They have thrown TWO resolutions at the Texas Capital and only a Tenth Amendment one is making it rounds. No one in the Texas Capital wants secession. So you can write all day, go to rallies. But nothing will get thru at the State Level. So enjoy your beer and meeting and get your blood pressure higher. But nothing is going to change Texas will still be the greatest State in the Union and TNM will still be crying each day until they die.

      • Don, I would caution expressing what the occupants of the Texas Capital want. It does not matter what they want. Their wants are determined by the people of this great state. When our legislators get to a point that they decide to make decisions not based on the will of the people, it’s time to remove them from office. Regardless of what President Obama and the whole of federal and state government may think, this is still a nation of the people, for the people and by the people. The people need to take a stand and take back our rights.

    • Think about this, Dave. Prior to the Civil War, was it legal for states to secede from the Union? I’m thinking….probably not. Had the British won the American Revolution, our forefathers would have been executed for treason. Legality is defined by the victorious. Thomas Jefferson warned us that the tree of Liberty must be refreshed from time to time by the blood of Patriots and Tyrants alike. We cannot allow a government to become so powerful that it only satisfies its own agenda at the expense of its citizens. The government must know that the people have a voice.

  2. I’m ready for the change. Everyone here has brought up good and valid points…but I want to get MY local representatives, state and federal in on this. I’m going to call my local State representative, and ask why he hasn’t gotten on this particular bandwagon yet. I like this message to Washington. It’s long overdue. I think it’s time Texas did it’s own thing. Politicians in Washington, aren’t merely out of touch with Texas…they are out of touch with simple variety. I suppose that is what comes, from endlessly spending the rightful earnings of millions of hard working Americans, like a drunken sailor imbibes cheap Rum on a two week shore leave. No viable budget passed in five years running…that bunch should be hung from the neck, until dead. Isn’t that what they USED to do to thieves? Later on, this practice declined… as did our great nation.

  3. I am100% behind him. As a state we are the most independent. We have the ability to completely take care of ourselves without the governments help. There are People from other states that are moving here because our economy is better. I love Texas and think that we should separate ourselves from a government that is destroying itself before it is to late!! American by birth….Texan by the grace of God!! :-)

    • Dawn is right! Lets open the door and bring the right people to Texas. The ones that are not afraid to live in a major Texas city and that are progress in their thinking and voting. Come on down liberals and democrats – we need to get out of the red and become blue again.

      • Don DeLaVega — maybe I am reading Dawn’s reply incorrectly, but she does not mention any specific political group. The people here are Proud to be Texans. Keep your political group to yourself and don’t stoop so low as to try and slither in your political agenda at page that promotes the State of Texas. I have my own political choices, but standing by a Texan comes before any of those political groups.

  4. I hope that Texas is only the first of many states to send Washington DC a firm reminder that we are not here to serve the federal government, rather, it’s the other way around. I would truly rather Texas not secede but band together with your sister states and change DC.

  5. As a true born Texan from a long line of Texans that date back to the war for Texas independence, I say Let’s Secede. The president has already declared war on the American people and Texas. We fought once for our independence and we will fight again, and win. The feds have not secured our borders per the treaty they made with Texas, so who needs them. It would save Texans millions in tax revenue for our great state and we can put our own natural born citizens on the border to secure it with force if need be. Heck, we can secure it with force if need be from the feds.

    • You mention “born texan” Texan means to be on the side of right. Your ancesters came from other states such as “Davy”, where they could live free from the hassles of Gov. I put the gov on the same side as Santa Anna. Texas must secede. I’m a Vietnam Vet, I will side with you, on the side of right. If Texas does secede would you welcome me and my family?

      • Joseph – Thanks for serving. But if we left you and the other veteran would not have any benefits in your new country. You would have to travel vast distance to get the services you need. Passport and everything. Get out and vote is the answer to all vets around the country.

    • Being a 7th generation Texan – you Billy are crazy. The only time we secede was to join an ass backward country known as a CSA. Mexico never let us go. So we were truly not an independent nation. Sam Houston try for years to become part of the U.S. It took the Mexican – American war to become a free state – with a define border. Before that Texas only claim to own the land. Mexico still came to the world that Texas was their state.

  6. What if we had a resolution on remaining a part of the U.S.A., despite http://www.USDebtClock.org? How many elected officials would vote for such a resolution? Meanwhile what if we had a public referendum on the subject here in the Lone Star State? How many Texans would reaffirm Washington D.C.’s debt and spend-happy ways by voting to remain a part of the USA? The way of the world is to pursue LOCAL control of how one’s tax dollars are spent. Our Government in Texas can balance a budget….Something Washington Refuses to do!! Protect our free speach, our right to bear arms, and our children from debt!!

    • We will always have debt. Micki how much do you owe. Student loans, mortgage, car loan,credit cards. This is part of life. Why did you vote for the U.S. Congress people, if they do the same thing over and over and over. Right now, your State Reps and Senators are doing the same thing. We make the changes every time we vote. If you just stay home and do not vote, then you were the problem.

  8. There are several things happening. HR 347 from the US and The Army: FM3-39.40 There is an Anti Sharia Law already in Texas, it just needs to get through The Texas Legislature. Obama has bo be watched like a hawk.

    • Judy – as a man of faith – I believe every person has a right to their beliefs. Anti Sharia Law This amendment does nothing more than target one faith for official condemnation. Texas is bigger and better than that.

  10. Can the states say ‘No More’ to Mordor on the Potomac?

    Our situation as a ‘Nation’…a collection of states…has become untenable. The corruption and the debt of the Federal Government has the probability of the restoration of America rapidly approaching a state of impossibility. Answering the original question is “Yes, they can say No More”, but with the impossibility of restoration and the limitations of nullification(s) due to the states being financially beholding to the Lords of Mordor on the Potomac the only hope for a state to retain its sovereignty is to secede from the Union.

    And secession is being more forcibly and realistically discussed within many of the state’s governments and citizenries. Secession IS constitutional despite the popular belief that it is not. The problem with our administration and its propensity to ignore said Constitution and the refusal to uphold and enforce existing laws along with police-state tactics that would make Stalin and Mao green with envy in their graves, I am very afraid that secession would not be viewed as a legal issue, but as a act of aggression and would result in another civil war.

    I believe Texas CAN survive without the shackles imposed on it from a run-away federal leviathan; it is one of the Top Ten economies of the world even when it is being bled by monies leaving the state. Imagine what we could do for a Republic of Texas with the extra billions.

    With all that said, it is time to quit ‘imagining’ and to stand firm with the concept and the implementation of secession by Texas from the Union. I do.

THAT CONTRACT SPECIFICALLY GIVES TEXANS THE RETENTION OF ITS SOVEREIGNTY TO LEAVE AT TEXANS DETERMINATION THAT ITS RIGHTS ARE BEING MESSED WITH.       • Don, I notice you pretty much have a negative comment for everything. You might want to get someone to do the numbers for you. The economy in Texas is stronger that the whole of the US. We currently have a surplus of funds, working with a part-time legislature and this is being done without the help of the federal government. If the money you currently give to the US to squander went into Texas coffers, it would only strengthen what is already strong. Why do you think President Obama met with Governor Perry to discuss how Texas has such a strong economy? Trust me, it’s not because they are such great fishing buddies.

  11. I think it’s a great beginning. I’ve been waiting for someone to stand up for TX. I was taught we had the right to secede. It now looks like we need to take our great state back!

I agree with Rep White , I think it’s time Washington D C and the President understands that Texans are fed up with their way of running the government and that we WILL stand up and let them know they work for US and not the other way around . But the question is how long will it take for the rest of the country to wake up and see how our government is pushing the country into a socialist nation ! The United States is flat Broke and no matter how much they tax us the American people as whole we will never be able to pay off their debt . So what is next for us as a state ? That is the question . We can stand and scream and holler til we take our last breath , we can send letters and call the senators and congressmen. But will that do eny good ? They can say yes we hear you BUT then what ? Yes I have little faith in the men and women we have put into office in Texas , and in the ones we have in Washington ,,,, But I have FAITH in GOD he will create a miracle and things will change .

  20. I see no other alternative to our liberty than secession. I do not say this without regret and concern. Like many other veterans, we fought in foreign wars in places we knew nothing about (Viet Nam in my case). Why would we not fight for our personal liberties that are in jeopardy? I know what this means and the possible sacrifices many of us may be called upon to do. Liberty is worth more than just ourselves. My children, grandchildren, and so on deserve it. This is not a new idea. Our US and Texas history proves to what extent we will go to be free from tyranny.

  21. Proud that my Representative has introduced this Resolution that is in line with the independent thinking of Texans. I support this Resolution without reservation!

  22. Nice resolution BUT it just doesn’t go far enough to express our outrage with DC tactics. Like so may stated it is just a nonbinding resolution and there meaningless for effect. The people already submitted a petition to Washington that made it perfectly Texas are not happy with DC. As such our legislators to to be a little more aggressive to Washington and make it clear we as Texans do not have to pay for or support their shenanigans. Also we can just walk out and leave them with the problems they are creating.

  23. All 13 original states were independent countries,contrary to the propaganda of Webster and Lincoln. Virginia concluded a treaty with France, something only states(sovereign entities) can do. Rhode Island and North Carolina did not immediately ratify the Constitution, and the other states did not invade them. The treaty between Great Britain and the states was between Britain and each state in its sovereign capacity. It wasn’t until Lincoln needed the tariffs from Southern ports that there was any major resistance to secession. New England threatened secession at least 3 times, and no one threatened to start a war. History has been rewritten by the victors to cover their crimes.
